Terms and Conditions

These Terms and Conditions (‘Terms’) set out the agreement between you (‘the Customer’) and Summit Mechanical Services Ltd (‘Summit’, ‘we’, ‘us’, or ‘our’) for the provision of air conditioning, ventilation, and refrigeration services. By using our services or requesting a quotation, you agree to these Terms.

2. Services Provided
Summit provides the following services:
- Design, supply, and installation of air conditioning, ventilation, and refrigeration systems
- Maintenance, servicing, and repairs
- Consultancy, inspection, and related HVAC support services
All work is carried out by qualified engineers in accordance with industry standards, relevant legislation, and manufacturer specifications.
3. Quotations and Pricing
- All quotations are valid for 30 days from the date of issue unless stated otherwise.
- Quotations are based on information provided at the time of issue. Any changes to the scope, site conditions, or access may result in a revised quotation.
- Prices are exclusive of VAT unless explicitly stated.
- Acceptance of a quotation constitutes an agreement to proceed under these Terms.
4. Payment Terms
- For residential clients, we request 50% up front for installations, with the remaining balance payable on completion.
- For commercial clients, payment terms are 30 days from invoice date, unless otherwise agreed in writing.
- All maintenance contracts, either commercial or residential, are payable prior to visit.
- Late payments may incur interest at the statutory rate under the Late Payment of Commercial Debts (Interest) Act 1998.
- We reserve the right to suspend or postpone services where payments remain outstanding.
5. Access and Site Conditions
- The Customer must ensure safe and reasonable access to the site for our engineers.
- All areas where work is to be carried out must be clear of obstruction prior to arrival.
- Summit accepts no responsibility for delays caused by restricted access, unforeseen site conditions, or third-party interference.
- If a visit cannot proceed due to access issues or unsafe conditions, a callout or rescheduling fee may apply.
6. Cancellations and Rescheduling
- Appointments may be cancelled or rescheduled up to 24 hours in advance without charge.
- Cancellations within 24 hours of the scheduled visit may incur a fee to cover time and travel costs.
- For contracted or subscription services, cancellation terms are outlined in your service agreement.
7. Materials and Equipment
- All materials and equipment supplied by Summit remain our property until paid for in full.
- Warranty coverage for materials and parts is provided in accordance with manufacturer terms.
- Any warranties are void if systems are modified, serviced, or repaired by a third party without written approval from Summit.
8. Guarantees and Warranties
- All work is carried out with due care and skill by qualified engineers.
- Installations are covered by the manufacturer’s warranty and Summit’s workmanship guarantee (typically 12 months unless otherwise stated).
- Regular maintenance is required to maintain warranty validity.
9. Liability
- Summit will not be liable for any indirect or consequential losses, including business interruption, loss of profit, or damage resulting from system failure.
- Our liability for any claim arising from our services will be limited to the value of the contract or the amount covered by our insurance, whichever is lower.
- Nothing in these Terms limits our liability for death, personal injury, or fraud resulting from our negligence.
10. Subcontracting
Summit may, where appropriate, engage trusted subcontractors to assist with service delivery. All subcontractors are fully qualified, insured, and bound by the same standards and confidentiality requirements as Summit staff.
11. Health, Safety & Compliance
We adhere to all relevant Health and Safety legislation, F-Gas regulations, and SafeContractor standards. Customers agree to notify Summit of any known site hazards or safety risks prior to the start of work.
12. Force Majeure
Summit will not be liable for any delay or failure to perform its obligations where such delay or failure is caused by events beyond our reasonable control (including extreme weather, transport disruption, illness, or material shortages).
13. Data Protection
We process all personal data in accordance with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018. Our full Privacy Policy is available at www.summitmechanical.co.uk/privacy-policy.
14. Governing Law
These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
